GTCs
1. GENERAL
Immobilien Service Fehmarn UG (hereinafter referred to as ‘Agent’) arranges holiday homes and holiday flats. All services are included in a booking confirmation, which the guest receives after booking.
2. CONCLUSION OF CONTRACT
The respective contract is concluded in principle after a verbal or written request by the contractual partner and by the acceptance of the agent. The above-mentioned booking confirmation is deemed to be a rental contract which is concluded by enquiry and confirmation. The Agent is free to accept the request in writing, verbally, in text form (e-mail, fax) or conclusively by providing the service.
3. RIGHTS AND OBLIGATIONS
The agent is obliged to provide the agreed services. The guest is obliged to pay the agent the agreed rental price. Until the day of arrival, the guest is entitled to have a third party assume the rights and obligations arising from the travel contract in his place. In this case, the guest and the third party shall be jointly and severally liable for the price of the holiday and any additional costs incurred as a result of the entry of the third party. The agent reserves the right to reject this third party for good cause.
4. REMEDY OF DEFECTS
The agent shall endeavour to remedy defects as soon as he becomes aware of them. Minor defects in the furnishings or the failure of an appliance do not justify a reduction in the rental price. Defects must be reported immediately at the start of the holiday. If defects are discovered after the guest's departure during the final cleaning that were not previously reported, these will be asserted as a claim and are payable within 10 days to the specified account.
5. CANCELLATION
The guest can cancel the contract at any time before the day of arrival. Up to four weeks before arrival, this is possible free of charge for the guest. From the 28th day before the planned start of the trip, 100% of the total amount will be charged. In this case, the agent recommends taking out travel cancellation insurance.
6. TERMS OF PAYMENT
Payment of the holiday price is due four weeks before the start of the rental period. Payment must be made to the agent's account in accordance with the booking confirmation. Other methods of payment can be provided by arrangement.
7. ARRIVAL
The holiday homes and holiday flats are usually cleaned shortly before your day of arrival and are available to you from 4 pm. You will receive the key code and further information about your stay by email before you start your holiday. Departure must take place by 10 a.m. on the last day of your booking.
8. ADDITIONAL COSTS
8.1 The additional costs for gas, water and electricity are included in the rental price.
8.2 The rental price also includes bed linen and towels (initial supply) according to the number of persons stated at the time of booking.
8.3 The rented property must be left swept clean on departure.
9. DEPARTURE
The holiday homes and holiday flats are usually cleaned immediately after your departure. Departure must take place by 10 am on the last day of booking. The property must be left in a swept clean condition (rubbish taken out, dishwasher emptied, bed linen removed, coarse dirt removed, etc.). If it is established during the final cleaning that this has not been done on departure, the additional costs incurred will be claimed and must be paid within 10 days to the specified account.
10. GENERAL OBLIGATIONS / HOUSE RULES / TENANT'S LIABILITY
The rental property may only be occupied by up to the maximum number of persons stated; the pitching of tents, caravans or mobile homes on the property is not permitted. Pets are not permitted in the holiday homes and holiday flats. All guests are required to comply with the applicable house rules, which are displayed in each property. Any items damaged or lost during the stay must be replaced by the tenant. The tenant is obliged to immediately report all defects and damage that occur during the time he/she occupies the rented property. The tenant is responsible for proving that the damage did not occur during the rental period and that he or the persons accompanying him are not at fault. The agent has no liability towards the tenant or his property. The tenant is therefore responsible for his own insurance cover during his stay. Complaints regarding the state of cleaning must be reported to the agent immediately on arrival and before moving in. If the tenant arrives outside office hours (10 a.m. - 6 p.m.), the tenant waives the right to complain about the cleaning. Complaints on and after departure will not be recognised. The tenant is obliged to treat the domicile with care and to leave it tidy and swept clean on departure. The registering tenant is personally liable for all fellow travellers. The agent cannot be held responsible for insects in the house or its surroundings. The agent is not responsible for any nuisance caused by neighbouring properties.
11. PLACE OF JURISDICTION
The exclusive place of jurisdiction is Fehmarn.
12. SEVERABILITY CLAUSE
The ineffectiveness of individual provisions of the rental agreement does not result in the ineffectiveness of the entire rental agreement.
